Protection of New Varieties of Plants Act - Official Consolidated Text /ZVNSR - UPB1/ (OJ RS, No 113/06)

The Act provides for:

• conditions concerning the protection of a new variety of plants in the Republic of Slovenia;

• persons entitled to variety protection;

• the content and the scope of breeder's right;

• the procedure for the protection of a variety;

• the duration of the procedure for variety protection;

• obligations of the holder of plant breeder's right;

• reasons for the termination of plant breeder's right;

• the transfer and assignment of the use of a plant breeder's right;

• the contents and the means of maintaining the register of applications and the register of protected varieties;

• the judicial protection;

• the supervision and transitional and penalty provisions.

The Act reflects the content of provisions of:

• INTERNATIONAL CONVENTION FOR THE PROTECTION OF NEW VARIETIES OF PLANTS (UPOV Convention)

With the date of entry into force of these Rules the following Rules ceased to be valid:

• Certification of new varieties, permits for introduction of foreign varieties and protection of varieties of agricultural and forestry plants act /ZPNSDI/ (OJ SFRJ, No 38/1980, 82/1990, RS, No 4/1991, 86/1998, 58/2002, 58/2002 (85/2002 - amended)) - in its part referring to the protection of varieties of agricultural and forestry plants act;

• Rules concerning the register of protected new domestic varieties and the register of protected foreign varieties of agricultural and forest plants (OJ SFRJ, No 56/89);

• Rules on data and information to be provided in the application for variety protection of agricultural and forest plants (OJ SFRJ, No 56/89).
