II. LEGISLATIVE TASKS
Phytosanitary Administration participates in
policy-making and implementation of the plant health policy, in drawing
up regulations in the field of plant health and provides for their
implementation.
As from the full membership most legislation is prepared in Brussels and
representative of the Administration participate in the Standing
Committee on Plant Health at the European Commission which prepares and
harmonises draft regulations adopted by the Commission. It also
participates in the preparation of European Council regulations.
Commission's decisions and Council's regulations apply directly for EU
Member States, while directives are transposed into their national
legislations.
Irrespective of the above-stated, in cases of risk for plant health the
head of the Administration may decide on phytosanitary measures at
import or in production. In doings so, he/she shall act in accordance
with regulations governing measures for the prevention of introduction
of organisms harmful to plants or plant products, into the Community and
their spread within the Community, while decision apply as the basis for
taking phytosanitary measures pending the issue of the minister's
regulation. The Administration shall inform of such emergency measures
the European Commission which assesses further measures at the Community
level.
