I. PROTECTION OF NEW VARIETIES OF PLANTS

2. Instructions for the application of variety
protection, application forms
An application for variety
protection and supplement thereto shall be lodged with the Phytosanitary
Administration of the Republic of Slovenia.
Applicants shall submit applications on
prescribed forms in two copies.
According to the
Decree
on the fees of The Office for the Protection and Registration of Species
of Plants of the Republic of Slovenia application fee for the
protection of a variety amounts to EUR 83,40.
The application fee shall be paid to the
Administration on the account No. 01100-1008303490, the Bank of Slovenia.
In the reference field of the payment order the following numbers shall
be inserted: 11 23213-7111185.

3. Procedure for the protection of a new plant
variety
The Administration shall start the procedure by
carrying out formal and substantive examination of the application. The
Administration shall check the completeness of the application, if it has been
properly filled-in and if it has been attached by a certificate on the
paid fee. When the application is complete, the applicant shall be issued a
certificate.
A complete application shall be entered in the
register of applications and published in the official gazette of the
Administration.
In the procedure for the protection of a variety,
foreign breeders (from third countries) shall have an authorised representative.
4. Conditions for the protection of a variety
Every variety may be protected provided to be new,
distinctive, uniform, stable and having a suitable denomination.
5. Testing distinctness, uniformity and stability (DUS) of a variety
From the professional point of view, testing
distinctness, uniformity and stability (DUS) of a variety is considered
the most important and demanding part of the procedure for the
protection of a variety, and is performed during field trials. DUS
testing is carried out following uniform methods (Rulres
on standard methods for testing the distinctness, uniformity and
stability of new varieties of plants). For varieties which have already
undergone the DUS testing, a final report shall be acquired in the
procedure through official channels.
Costs of the DUS testing are provided for in the
Decree
on the fees of The Office for the Protection and Registration of Species
of Plants of the Republic of Slovenia and shall
be paid to the Administration on the account No. 01100-1008303490, the
Bank of Slovenia In the reference field of the payment order the
following numbers shall be inserted: 11 23213-7111185.

6. Register of protected varieties
When the procedure has been completed and all the
prescribed conditions have been satisfied, the Administration shall
issue a decision for the protection of the new variety and on granting
the plant variety right to the holder. The variety protection shall have
a life of 20 years and in the case of tree species 25 years, with no
possibility for extension. If the variety does not satisfy the
conditions in respect of protection, the Administration shall issue a
decision on rejecting the application.
For protected varieties a fee shall be paid each
year for the maintenance of the plant variety right pursuant to
the Decree on
the fees of The Office for the Protection and Registration of Species of
Plants of the Republic of Slovenia. The annual fee shall be paid to
the Administration on the account No. 01100-1008303490, the
Bank of Slovenia In the reference field of the payment order the
following numbers shall be inserted: 11 23213-7111185.
