VI. ENTRY INTO THE REGISTER OF SUPPLIERS AND OBTAINING OF THE AUTHORISATION FOR THE ISSUE OF SUPPLIER'S LABELS AND DOCUMENTS

A) REGISTER OF SUPPLIERS (SEEDS-register)

1. Legal basis

Agricultural Seeds and Propagating Materials Act

Rules on keeping of the register of suppliers of agricultural seed and propagating material

Legislation on the marketing of agricultural seeds and propagating material

2. Persons liable to be entered in the register of suppliers ("SEME-register")

Entry into the register of suppliers shall be necessary for natural and legal entities, which are involved in the production, market preparation, placing on the market or import of agricultural seeds aand propagating material within the teritorry of the Republic of Slovenia.

3. Acceptance procedure

Application for the entry into the register of suppliers shall be lodged with the Phytosanitary Administration of the Republic of Slovenia, on the form (form: Application for entry into the SEME-register)

For submission of the application and issuing a decision administrative fees are NOT payed.

The Administration shall enter a supplier in the register of suppliers after having established that the supplier has provided a responsible qualified person and meets the obligations of supplier.

4. Unique registration number of supplier

Upon entry into the register of suppliers, the Administration shall deliver a supplier a UNIQUE REGISTRATION NUMBER. The UNIQUE REGISTRATION NUMBER shall be applied in all proceedings governed by the Administration or a competent phytosanitary or agricultural inspection on the basis of the Agricultural seeds and propagating material act. The unique registration number represents mandatory information to be given on the suppleir's labels and certificates.

B) AUTHORISATION FOR THE ISSUE OF SUPPLIER'S LABELS AND DOCUMENTS

1. Legal basis

Agricultural Seeds and Propagating Material Act

Rules on the marketing of vegetable propagating and planting material, other than seed

Rules on the marketing of propagating material of ornamental plants

Rules on the marketing of material for the vegetative propagation of the vine

Rules on marketing requirements and on the marketing of fruit plant propagating material and fruit plants intended for fruit production

Legislation covering for the area of the marketing of agricultural seeds and propagating material

2. Who is liable to obtain an authorisation for the issue of supplier's labels and supplier's documents?

The authorisation shall be obtained by registered suppliers involved in the processing and placing on the market of the following material, attached by/marked with labels or certificates of supplier:

- vegetable propagating material (vegetable planting material, onion sets, cloves of garlic, bulbs of shallots), other that seeds;

- propagating material of ornamental plants (seeds, grafts, cuttings, rootstocks, bulbs, tubers, rhizomes, plants for the production of propagating material);

- propagating material (grafts. rootstocks, pits for the production of seedlings) and fruit plants of the 'CAC' category;

- top-graft cuttings and grafts of vine of the category 'standard material'.

3. Authorisation-obtaining procedure

Application shall be lodged with the Phytosanitary Administration of the Republic of Slovenia on the form (form: Application for authorisation for the issue of labels and documents of supplier)

For submission of the application and issuing a decision administrative fees are NOT payed.

The application shall be attached by samples of labels or documents of supplier, which the supplier shall be issuing in respect of seeds and propagating material pursuant to rules regulating marketing (Legislation covering for the area of the marketing of seeds and propagating material)

The Administration shall grant the authorisation to the supplier after having established that the supplier meets the obligations of supplier pursuant to the Agricultural seeds and propagating material act and if samples of labels have been provided pursuant to rules regulating marketing.

After 1 January 2006 the issue of labels and documents of supplier SHALL NOT BE PERMITTED without the authorisation issued by the Phytosanitary Administration of the Republic of Slovenia.
